■ SOUTH AFRICA: NTM calls off strike, to take dispute with SAA to Labour Courts.

South Africa's National Transport Movement trade union has ended its 28 day strike but said it will seek an order from the South African Labour Court this week to compel South African Airways (SA) to grant it recognition rights. 


South African Airways The NTM's move comes after the arbitrator in their dispute with SAA, the Commission for Conciliation, Mediation and Arbitration (CCMA), ruled in SAA's favour stating that an audit of the NTM's membership showed that the union had indeed fallen short of the required 30% needed for recognition by SAA.
"Our next step is to go to court and to get an order from the judge. The judge must review the information in the report and make out an order that NTM be granted organisational rights, especially in the light that SAA has recognised Solidarity," NTM general secretary Craig Nte said in an interview on Friday.

Amongst the issues raised, Mr Nte argued that the CCMA's report has erred in its report as its membership numbered 1'204 or 29.69% of the SAA workforce - which was "30% when when rounded up".

Whilst the CCMA had originally recommend partial recognition for the union by SAA, as early as last year in November, SAA has remained steadfast in its belief that recognition of the NTM could only come once they had satisfied all requisite criteria.
